Who this policy applies to

This Privacy Policy applies to you if you are a customer or consumer located in the United States who interacts with Influxious Inc. (“Influxious,” “we,” “us,” or “our”) through our website at influxious.co. This includes buying directly from us, signing up for our newsletter, entering a promotion or giveaway, requesting a sample, submitting a review, joining a loyalty program, or contacting us about our products.

It explains the personal data we collect, how and why we use it, who we share it with, how we keep it secure, and the choices and rights you have. It contains additional information for residents of US states that have their own data privacy laws, including California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia. As a Texas company, we comply with the Texas Data Privacy and Security Act and other applicable state laws.

“Personal data” or “personal information” means any information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular individual or household. Not everything below will apply to you.


What this policy does NOT cover

This policy covers influxious.co and your direct interactions with us. It does not cover:

  • Purchases or interactions at our retail partners. If you buy Influxious products at Sephora.com, in a Sephora store, or through any other retailer, that retailer collects and controls your data under its own privacy policy. Please review the retailer’s policy for those purchases.

  • Third-party websites, apps, or social platforms that link to or from our site. They have their own privacy policies, and we are not responsible for them.

  • Influxious employees, contractors, and shareholders, who are covered by separate policies.

Cookies and similar technologies

We use cookies and similar technologies (pixels, tags, and SDKs) to operate influxious.co, remember your cart and preferences, measure site performance, and deliver and measure advertising. Some cookies are strictly necessary for the site to function; others are used for analytics and advertising and are only set with your consent where required.

Analytics

We use web analytics tools to understand how visitors use our site and to improve it. These tools may collect pages visited, time on site, device and browser type, approximate geographic location, referral source, and navigation behavior, including a truncated IP address where applicable.


How long we keep your data

We keep personal data only as long as we need it for the purposes described in this policy, and as required by law:

  • Account data: while your account is active. We may deactivate and delete or de-identify accounts after an extended period of inactivity.

  • Marketing data: typically up to three years from your last interaction with us, unless you opt out sooner.

  • Order and transaction data: as long as needed to fulfill the order and for a reasonable period afterward for returns, disputes, and our tax and accounting obligations.

  • Reviews and user-generated content: for a reasonable period necessary for the purpose it was collected.

Once data is no longer needed, we delete, de-identify, or aggregate it.


Sensitive personal information

Some US state laws treat certain categories as “sensitive,” including information revealing race or ethnicity, religious beliefs, health conditions, sexual orientation, genetic or biometric data, a child’s personal information, and precise geolocation. We do not seek to collect sensitive personal information in the ordinary course of selling fragrance. Where we do process it, we do so only as permitted by law or with your consent, and we do not sell or share sensitive personal information.


Automated processing and fraud prevention

We may use automated techniques to secure transactions placed through our site and to detect and prevent fraud. This may be fully automated or involve human review. Our e-commerce platform, Shopify, may perform automated processing for these purposes. We take reasonable safeguards to limit access to your data in this process.


How and with whom we share your data

We do not sell your personal data for money. We share personal data only as needed, with the following categories of recipients:

  • Service providers who help us run the business and process data only on our instructions, including: our e-commerce platform (Shopify), our email and SMS platform (Klaviyo), payment processors, shipping and fulfillment partners, customer service tools, reviews platforms, and IT and hosting providers.

  • Advertising and analytics partners who help us deliver and measure marketing. See the list below.

  • Legal and safety recipients, where we are required to comply with law, enforce our terms, or protect the rights, property, or safety of Influxious, our customers, or others.

  • A buyer or successor, if we sell or transfer all or part of our business or assets, in which case your data may transfer to the new owner under its privacy policy.

Under some US state laws, sharing data with advertising or analytics partners for cross-context behavioral advertising may be considered a “sale” or “sharing.” Where that applies, you have the right to opt out (see Your privacy rights below).

Where we store your data

We are based in the United States and store and process your personal data primarily in the US. Some of our service providers may process data in other countries; where they do, we require appropriate contractual and technical safeguards to protect it.


Children’s privacy

Our website and products are intended for a general adult audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If we learn we have collected such information without the required consent, we will delete it as soon as reasonably possible. A parent or guardian may contact us using the details below to review, delete, or stop the collection of their child’s information.


Your privacy rights and choices

Depending on the US state you live in, you may have some or all of the following rights. We will verify your identity before acting on a request and respond within the timeframe required by law. We will not discriminate against you for exercising these rights.

Right to know and access

You can ask what categories of personal data we collect, use, and share, the sources and purposes, and the categories of third parties we share with, and you can request a copy of the specific data we hold about you.

Right to delete

You can ask us to delete the personal data we have collected from or about you, subject to legal exceptions.

Right to correct

You can ask us to correct inaccurate personal data we hold about you.

Right to data portability

You can ask to receive your personal data in a structured, commonly used, machine-readable format.

Right to opt out of sale, sharing, and targeted advertising

You can ask us to stop selling or sharing your personal data and to stop using it for targeted advertising, including through cookie-based tracking. You can do this by contacting us at privacy@influxious.co or by using the cookie settings tool on our site.

Right to limit use of sensitive personal information

Where applicable, you can ask us to limit our use and disclosure of sensitive personal information.

Right to a list of categories of third parties

You can request a list of the categories of third parties to which we have disclosed your personal data.

California “Shine the Light”

California residents may request information about disclosures of personal data to third parties for those third parties’ own direct marketing. We do not share personal data with third parties for their own direct marketing purposes. To make this request, email privacy@influxious.co.

How to exercise your rights

Email us at privacy@influxious.co. You may also opt out of marketing emails using the unsubscribe link in any email, or opt out of SMS by replying STOP. Email opt-outs can take up to about 10 business days to take full effect as our systems update.


Changes to this policy

We may update this policy from time to time to reflect changes in law, technology, or our practices. We will post the updated policy here with a new “last updated” date. If we make material changes that affect your rights, we will provide additional notice where required, such as by email or a notice on our site. Your continued use of our services after an update means you have read and understood the revised policy.
